These terms and conditions ("Terms") govern your use of bergenfjordsafari.com and the tours, charters, and services provided by Bergen Fjord Safari AS. By booking a tour, submitting a quote request, or using any of our services, you agree to be bound by these Terms.

Please read them carefully. If you have any questions, contact us at post@bergenfjordsafari.com before you book.

1. Definitions

In these Terms:

  • "We", "us", "our", "the Operator" means Bergen Fjord Safari AS, organisation number 935 996 007, Strandkaien 16, 5013 Bergen, Norway.
  • "You", "the Guest", "the Customer" means any person booking a tour, submitting a request, or participating in any of our services.
  • "Tour" means any scheduled group departure, private charter, or other activity we offer.
  • "Booking" means a confirmed reservation for one of our Tours.
  • "Website" means bergenfjordsafari.com and any related subdomains operated by us.
  • "RIB" means Rigid Inflatable Boat, the type of vessel used for our Tours.

2. Booking and confirmation

By booking a Tour, you confirm that you have read, understood, and agreed to these Terms.

Bookings are made through our Website, by phone, by email, or through authorised third-party resellers. A Booking is only binding once you receive a written confirmation from us by email. Third parties, including our distribution partners and agents, have no authority to make promises or agreements that modify or go beyond these Terms.

Your confirmation email contains your booking reference and serves as your ticket. Please show it on your phone or in printed form at check-in.

You are responsible for ensuring that all information provided at the time of Booking is accurate, including names, number of guests, contact details, and any medical or accessibility information relevant to your participation.

3. Payment

All Tours must be paid in full at the time of Booking. We accept major credit and debit cards (Visa, Mastercard, American Express) through our secure payment partner Stripe, processed via the Bókun booking platform.

For private charters, invoicing by prior arrangement may be available. Terms of payment will be stated in the written quote.

All prices are listed in Norwegian Kroner (NOK) and include 25% Norwegian value-added tax (VAT) unless explicitly stated otherwise.

4. Cancellation and changes

Cancellations by you

  • More than 24 hours before departure: Free cancellation or date change
  • Less than 24 hours before departure: 100% cancellation fee, no refund
  • No-show: 100% cancellation fee, no refund

This applies to both scheduled group departures and private charters.

To cancel or change a Booking, contact us at post@bergenfjordsafari.com or +47 473 48 911, stating your booking reference. Cancellations are effective from the time we receive your written confirmation.

For larger group or multi-boat charter bookings, alternative cancellation terms may be set out in the written quote.

Cancellations by us

We may cancel or reschedule a Tour due to weather, safety concerns, mechanical issues, or other circumstances beyond our reasonable control. If we cancel:

  • You will be offered the choice between a full refund or rescheduling at no extra cost.
  • We are not liable for any additional expenses you may have incurred (travel, accommodation, etc.).

5. Services provided

The services included in your Booking are described on the Website and in your booking confirmation. These may include:

  • Transport on a premium RIB vessel
  • An experienced, certified skipper
  • Safety equipment: flotation suits, life jackets, goggles, gloves, and hats
  • Guidance and commentary along the route

Routes, stops, and exact duration may vary depending on weather, tidal conditions, sea state, wildlife, or other factors. The skipper has final authority on the route and may deviate from the planned itinerary if safety or circumstances require. Such variations do not entitle you to a refund unless the Tour is cancelled entirely.

Some Tours are operated in a different format during winter months or off-season. Current operating conditions are noted on the product page at the time of Booking.

6. Your responsibilities as a guest

You agree to:

  • Arrive at the meeting point at least 20 minutes before scheduled departure
  • Follow all safety instructions given by our skipper and crew
  • Wear all provided safety equipment correctly
  • Behave in a way that does not endanger or disturb other guests
  • Inform us in advance of any medical conditions, pregnancies, or mobility limitations that may affect your participation
  • Comply with the age restrictions stated on each Tour's product page

We reserve the right to refuse boarding, or to remove a guest from a Tour, if we reasonably believe that participation would be unsafe for the guest or others — including in cases of intoxication, aggressive behaviour, or failure to follow safety instructions. In such cases, no refund will be given.

Age restrictions and minors

Children under 8 years old are not permitted on scheduled group departures. For private charters, minimum ages may be more flexible — please ask when booking.

If you are travelling with children or other minors in your care, you are fully responsible for their conduct, safety, and wellbeing throughout the Tour. Our skipper and crew are not responsible for supervising minors.

Accessibility and health

Our Tours involve physical movement, high-speed travel on open water, and exposure to wind and weather. They are not recommended for:

  • Pregnant guests
  • Guests with serious back, neck, or heart conditions
  • Wheelchair users (our current vessels are not accessible)

If you are unsure whether a Tour is suitable for you, contact us before booking.

7. Safety and assumption of risk

You acknowledge that participating in a RIB Tour involves inherent risks that cannot be completely eliminated, including but not limited to:

  • Physical exertion
  • Risk of personal injury from sea state, impacts with waves, or moving around the vessel
  • Exposure to weather, sun, cold, and sea spray
  • Risk of property damage or loss to personal belongings brought on board

By booking and participating in a Tour, you confirm that you understand and accept these risks. You participate voluntarily and with full knowledge of these risks.

Our skippers are trained in maritime safety and first aid. In case of injury or illness during a Tour, the skipper will take appropriate action, which may include returning to port, contacting emergency services, or arranging medical evacuation. Any medical or emergency costs incurred are the responsibility of the affected guest.

We strongly recommend that all guests have adequate travel and medical insurance before participating.

8. Personal belongings

You bring personal belongings on board at your own risk. We are not responsible for loss, theft, or damage to items including (but not limited to) phones, cameras, electronics, clothing, glasses, jewellery, or bags.

We recommend waterproof bags or cases for electronics and leaving valuables at your accommodation.

9. Food, drink, and substances

  • On scheduled departures, food and drink are not provided on board. Light snacks and water may be consumed at the skipper's discretion.
  • On private charters, you may bring your own food and drink, or arrange catering through us.
  • Alcohol consumption is permitted on private charters at the skipper's discretion. The skipper may refuse further consumption or boarding if behaviour becomes unsafe.
  • Use or possession of illegal drugs is strictly prohibited and will result in immediate termination of the Tour without refund.

We are not responsible for food allergies, food-borne illness, or any consequences related to food or drink consumed before, during, or after a Tour.

10. Weather and force majeure

We operate year-round in most weather conditions. Light rain or wind does not normally lead to cancellation — the provided flotation suits are designed to keep you warm and dry.

However, we are not responsible for circumstances beyond our reasonable control. Where such circumstances make it impossible to operate the Tour as planned, we distinguish between two situations:

Situations that may lead to cancellation and refund or rescheduling:

  • Weather or sea conditions that our skipper judges to be unsafe for the operation of the Tour
  • Strikes, civil unrest, pandemics, or governmental restrictions that prevent the Tour from operating
  • Port closures or other circumstances entirely outside our control that make departure impossible

A refund or rescheduling is only offered if the Tour is cancelled entirely. Weather conditions that reduce visibility or require a change of pace — but do not prevent safe operation — are not grounds for refund. In the event of cancellation, we will reschedule at no extra cost or offer a full refund. We are not liable for any secondary costs you may have incurred (travel, accommodation, missed connections, etc.).

Situations handled by route adjustment — not a basis for cancellation or refund:

  • Ice formation in inner fjords during winter — in this case the skipper will choose an alternative route. The Tour will proceed as scheduled and no refund or rescheduling will be offered.

11. Liability and release

To the fullest extent permitted by Norwegian law, you agree that:

  • We are not liable for any injury, illness, loss, damage, or death arising from participation in a Tour, except in cases of gross negligence or wilful misconduct on our part.
  • You waive and release any claims against Bergen Fjord Safari AS, its employees, skippers, agents, and affiliates for any damages or losses arising from your participation, except as provided by mandatory Norwegian consumer law.
  • Our total liability for any single Booking is limited to the amount paid by the Guest for that Booking.
  • We are not liable for any indirect, consequential, or incidental losses, including loss of enjoyment, loss of business, or missed connections.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Norwegian law, including liability for death or personal injury caused by our gross negligence, or liability under the Norwegian Consumer Purchase Act where applicable.

12. Insurance

We maintain insurance coverage as required by Norwegian law for the operation of passenger vessels. Our insurance covers us as the Operator.

Your personal property, medical expenses, and trip cancellation are not covered by our insurance. We strongly recommend that all guests obtain adequate travel and medical insurance for their trip.

13. Photography and video

Our skippers and crew may take photos or video during Tours for use on our Website, social media, and marketing materials. By participating in a Tour, you consent to being photographed or filmed in this context.

If you prefer not to appear in photographs or video, please inform the skipper at the start of the Tour.

You are welcome to take your own photos and video for personal use. Commercial photography or filming — including paid productions, content creation for monetised platforms, or media assignments — requires prior written agreement.

14. Intellectual property

All content on the Website, including text, images, logos, videos, and design, is owned by or licensed to Bergen Fjord Safari AS and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content without our prior written permission, except for personal, non-commercial use.

15. Complaints and disputes

If you are unhappy with any aspect of our service, please let us know as soon as possible — ideally during or immediately after the Tour, so we have the chance to address it directly.

Complaints can be sent to post@bergenfjordsafari.com. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days.

If we cannot reach a resolution, Norwegian consumers may refer the dispute to the Norwegian Consumer Authority (Forbrukertilsynet) at forbrukertilsynet.no ↗.

16. Governing law and jurisdiction

These Terms are governed by Norwegian law. Any dispute arising in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the Norwegian courts, with Bergen District Court (Hordaland tingrett) as the agreed venue in first instance.

Nothing in this clause limits mandatory consumer rights under Norwegian law.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced, to the extent possible, by a valid provision that most closely reflects the original intent.

18. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the most recent changes took effect. The Terms in force at the time of your Booking apply to that Booking.

For material changes affecting existing Bookings, we will notify affected customers by email.
